License Agreement

Please read the terms and conditions of this License Agreement carefully before using fabpower.org. This is a legal agreement between you and fabpower.org (operated by Fabtech Software Inc.). By accessing or using the fabpower.org service, you accept all the terms and conditions of this Agreement. If you do not agree with the terms and conditions of this Agreement, please discontinue use of the service.

You may not sublicense, rent, lease or transfer your fabpower.org subscription without our prior written consent. You may not reverse engineer, decompile, disassemble, modify, translate, or attempt to discover the source code of any fabpower.org software or service. You may not use fabpower.org as part of facility management, timesharing, service provider, or service bureau arrangements. You may not use the service in any manner that is not permitted pursuant to this License Agreement.

By uploading and reusing content through our service, you agree not to access it for any reason other than your lawful personal or business use. The content might be subject to copyright and other intellectual property rights under the law. Such content may not be reproduced, distributed, transmitted, re-uploaded, republished, displayed, sold, licensed, made available or otherwise communicated to the public or exploited for any purposes except those permitted by the applicable rights holder.

The fabpower.org service is licensed, not sold. A valid subscription grants you a non-exclusive, non-transferable right to access and use the Photo Enhancer AI service for the duration and within the limits of your selected plan. A free tier may be available with daily usage quotas; sustained or larger-scale use requires an active paid subscription. You may not resell, repackage, or use the service to build a competing offering.

In no circumstances will fabpower.org be liable to you for any damages, claims, or costs whatsoever (whether in contract, tort, negligence, or otherwise), including, without limitation, any lost profits, lost savings, lost information, loss of data, or any consequential, indirect, or incidental damages. The foregoing limitations and exclusions apply to the fullest extent permitted by applicable law in your jurisdiction. Nothing in this License limits fabpower.org liability to you in the event of death or personal injury resulting from our negligence or fraud.

If any part of this License is found to be void and unenforceable, it will not affect the validity of the remainder of this License, which shall remain valid and enforceable according to its terms. This License may only be varied in writing and signed by an authorized representative of fabpower.org. Updates to the service may be provided by fabpower.org with additional or different terms, but fabpower.org has no obligation to provide any updates.

This License is the entire Agreement between you and us and supersedes any prior representations, undertakings, or advertising relating to the service. You acknowledge that in entering into this License you have not relied on any statement, representation, advertising, assurance, or warranty (whether made negligently or innocently) other than as expressly set out in this License. fabpower.org is entitled to transfer or assign any of its rights or obligations under the License. Copyright of all materials contained in the fabpower.org website and service — including related web pages, the structure and design of web pages, images, and any other information of the website and service — is owned by Fabtech Software Inc. Any duplication, reproduction of the contents, mirroring on servers that are not owned by Fabtech Software Inc., or any illegal use in any other form, is not permitted without clear permission in writing by Fabtech Software Inc. Fabtech Software Inc. reserves all rights to take legal action and claim responsibility.
